PICKY Terms of Service

Hello, this is PICKY. These Terms outline how you may use our website pickypudding.myshopify.com, place pre-orders, and access our services, including delivery and pickup of freshly made puddings. By using our site or services, you agree to abide by these Terms, as well as our Privacy Policy and Refund & Cancellation Policy.


1. About PICKY

PICKY creates rich, cream based puddings, freshly prepared and only available exclusively via pre-order. Customers can enjoy our cream puddings through pickup or delivery within the Sydney areas covered by our service. Pickup service is offered at Harmony mart 16-18 Quay St, Haymarket NSW 2000. 2. Ordering & Payments
  •  Pre-ordering

Pre-orders are placed on pickypudding.myshopify.com. All orders are subject to availability and our confirmation. We may cancel or decline orders in situations including:

  1. Limited stock or ingredients.
  2. Suspected fraudulent activity.
  3. Errors in product descriptions or pricing.
  4. Inaccurate delivery information provided by the customer.
  •   Product Information & Customization

We strive to provide accurate product descriptions, images, and pricing. Slight variations in appearance may occur due to handmade preparation. Prices are in AUD.

Custom pudding requests are generally not accepted unless specifically approved by our team. For large or catering orders, please email pickypudding.au@gmail.com to discuss additional terms.

  •  Payment

Payments are processed securely via trusted providers such as PayPal. By submitting payment, you confirm authorization to use the chosen method. PICKY is not responsible for issues beyond our control during payment processing.

 


3. Delivery & Pickup
  •  Delivery

Delivery is available within Sydney where our service operates. Please verify your postcode at checkout. Delivery windows :  Monday & Thursday: 8 AM – 6 PM

You will receive a tracking number or link prior to delivery. Ensure someone is present to receive the order. As puddings are freshly made, we recommend collecting within the specified window. If unattended, we may leave the pudding in a safe location.

  •  Pickup

Pickup orders can be collected at Harmony mart 16-18 Quay St, Haymarket NSW 2000 during the scheduled time. Orders not collected by the end of the day are considered fulfilled unless faulty.

  •  Pudding Storage

Most puddings stay fresh in the fridge for up to 24 hours. Items with fresh fruit (e.g., Mango White Chocolate Pudding) or fresh mochi (e.g., Thai Tea Mochi Pudding) should be consumed on the day of pickup or delivery. Customers are responsible for following storage instructions.


4. Cancellations & Refunds

Cancellations and refunds follow our Refund & Cancellation Policy:

  • Standard orders: Minimum 48 hours’ notice.

  • Catering or large orders: Minimum 72 hours’ notice.

Refunds are available for faulty, incorrect, or undelivered orders under Australian Consumer Law (ACL). Change-of-mind refunds are not offered after preparation, though store credit may be granted at our discretion.


5. Legal & Liability
  • Intellectual Property

All content on pickypudding.myshopify.com (images, logos, text) is owned by PICKY and protected under Australian copyright and trademark laws. Use for personal, non-commercial purposes is allowed only with permission.

  • Limitation of Liability

To the maximum extent allowed by law:

  1. PICKY is not responsible for indirect or incidental losses (e.g., loss of enjoyment).
  2. Liability under ACL consumer guarantees is limited to replacement, refund, or store credit.
  3. Delays or issues caused by third parties (e.g., couriers, payment providers) or unforeseen events (e.g., natural disasters, power outages) are not our responsibility.
  4. Customers assume responsibility for allergic reactions or dietary concerns, unless we fail to disclose ingredients as required by law.
  •  Indemnity

You agree to hold harmless PICKY, its employees, and representatives against any claims, losses, or damages arising from your violation of these Terms, improper use of our services, or submission of incorrect information.


6. Privacy

Your personal information is handled according to our Privacy Policy. By using our services, you consent to how we collect, use, and share your information.


7. Changes to Terms

We may update these Terms to reflect legal requirements or operational changes. Updates will be posted on pickypudding.myshopify.com with the “Last Updated” date. Continued use of our services constitutes acceptance of the revised Terms.


8. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the jurisdiction of NSW courts.
